Telltale Hit With Possibly Bogus Lawsuit, More Joker Photos Released and More! – ComicCorp News

Telltale Hit With Class Action – Way to kick a horse after it died of heat stroke and has started to decompose weeks later.   Former employee Vernie Roberts is representing himself and other former employees in a Class Action Lawsuit against the studio.  The lawsuit claims they were let go “without cause” (a lack of funds is in fact cause, but…whatever), and cites the WARN Act as part of the lawsuit claiming they should of been given advanced warning prior to the layoffs.   I’ll come back around to the WARN Act.

He (and a second source) allege that 275 people were let go, with no severance package and with expiring healthcare coverage.

Now the issue with citing the WARN Act is that it 1) does NOT cover contracted employees, merely your typical hourly wage type.  And according to @emilybuckshot on Twitter, most employees were.  It 2) also does not cover businesses that simply went out of business due to lack of funds.  Because the company stated that they fought to keep the company going, and kept looking for ways of making it happen, that would seemingly nullify the whole lawsuit.  It’s also worth nothing that this act usually only covers mergers of factories, not companies that simply cease operations or even just non factory type jobs usually.  Unless there was a deal in place for months to sell Telltales to a bigger studio before the closing, there is no basis for the lawsuit; which is probably why the former employee is representing it himself.
